ORDER

 

            Until further orders, the allocation of Judicial business amongst Judges sitting at Panaji shall be as follows with effect on and from 30th October 1982.

 

1.         Save as otherwise exprossly provided in this order, the Civil and Criminal Jurisdiction of the High Court shall be exercised by Division Courts and Single Judges as provided in Rules 2 to 6 of Chapter 1 of the Bombay High Court Appellate Side Rules.

 

2.         Except as otherwise provided in Item No. 3 below, all Writ Petitions under Article 226 or Article 227 of the Constitution shall be heard by a Division Bench consisting of two Judges.

 

Provided that during vacation or on holiday or when Courts are not in session, a single Judge may issue notice or rule, as the case may be, in any matter of an emergent nature, and may pass such interim orders regarding stay, injuction, bail and other interim relief as he may deem fit.

 

3.        Writ Petitions under Articles 226 or Articles 227 of the Constitution (or application styled as applications under Articles 227 of the Constitution read with Articles 226 of the Constitution) arising out of the two following proceedings shall be heard by a Single Judge:- (i) The Decrees or the orders passed by any Subordinate Court in any suit or proceeding (including suits and proceedings under any Special or Local Law).

(ii)  The decrees or two orders passed by any Subordinate Court in appellate or revision proceedings arising from suits or proceeding (including suits and proceedings under any Special or Local Law.

(iii)  Orders passed by the Administrative Tribunal in Revenue matters under section 6 of the Goa, Daman and Diu Administrative Tribunal Act, 1965/ W Section 138 of the Goa, Daman and Diu Land Revenue Code, 1966.

(iv)  Orders passed under the Goa, Daman and Diu Agricultural Tenancy Act, 1964.

(v)   Orders passed under the Goa, Daman and Diu Mundkars (Protection from Eviction) Act, 1975. 

(vi)  Orders passed under the Goa, Daman and Diu Town and Country Planning Act, 1974.

(vii) Orders passed under the Goa, Daman and Diu Buildings (Lease, Rent and Eviction) Control Act, 1968.

(viii) Orders passed under the Goa, Daman and Diu Housing Board Act, 1968.

(ix)   Order Passed under the Slum Areas (Improvement and Clearance) Act, 1956.

(x)    [Order and Awards passed under the Industrial Disputes Act, 1947].

(xi)   The decision given in proceeding in respect of disputes under Section 91 of the Maharashtra Co-Operative Societies Act as made applicable to Goa, Daman and Diu.

(xii)   Order passed by the Appellate Authority under Section 31 of the Beedi & Cigar Workers, (Conditions of Employment Act, 1966.

(xiii)  Order passed under the Goa, Daman, and Diu (Lease, Rent and Eviction) Control Act, 1968.

(xiv)  Order passed by the appropriate Government or the Appellate Authority under Section 7 and the orders passed by the Controlling Authority under Section 8 of the Payment of Gratuity Act, 1972.

(xv)   [Orders Passed under the Goa, Daman, and Diu Mamlatdar’s Court Act, 1966 in so far as it relates to local jurisdiction of Goa Bench of High Court of Bombay].
