NOTIFICATION

 

THE HIGH COURT AT BOMBAY (EXTENSION OF JURISDICTION TO GOA DAMAN AND DIU) REMOVAL OF DIFFICULTIES ORDER, 1982.

 

            G.S.R.  The following order made by the Central Government under sub-section (1) of section 13 of the High Court at Bombay (Extension of Jurisdiction to Goa, Daman and Diu) Act, 1981 (26 of 1981) is hereby notified as required by that sub-section namely:-

 

            In exercise of the power conferred by sub-section (1) of section 13 of the High Court at Bombay (Extension of Jurisdiction to Goa, Daman and Diu) Act, 1981 (26 of 1981), hereinafter referred to as the said Act, the Central Government makes the following order, namely:-

 

1.         SHORT TITLE AND COMMENCMENT.     (1) This order may be called the High Court at Bombay (Extension of Jurisdiction to Goa, Daman and Diu) Removal of difficulties order, 1982.

 

(2) It shall come into force on the appointed day as defined in clause (a) of section 2 of the said Act.

 

2.         ADAPTION OF RULES AND FORMS  (1) All the rules relating to procedure and conduct of cases before the Court of the Judicial Commissioner (including rules for the charging of fees for certified copies and for court processes) which were in force immediately before the appointment day (hereinafter referred to as the said rule) shall continue in force and shall be applicable mutatis mutandis to proceedings before the bench of the High Court at Bombay established under section 9 of the said Act, (hereinafter referred to as the said bench subject to the power of the said High Court to repeal or alter them. The powers which were exercised by the Registrar of the Court of the Judicial Commissioner for Goa, Daman and Diu under the said rules immediately before the appointed day shall be exercised by the Special officer of the said bench.

 

(2) In the absence of any provision in the said rules on any particular matter, the Bombay High Court Appellate Sides Rules, 1960 shall apply to proceedings before the said bench.

 

(3) The rules framed by the Court of the Judicial Commissioner under any law enabling him in this behalf for guidance of the Subordinate Judiciary in the Union Territory of Goa, Daman, Diu before the appointed day shall continue in force until further orders.

 

(4) The forms of writs as are followed in the High Court of Bombay, shall be followed in proceedings before the said bench.
